ARTICLE 2 - SUBJECT

The subject of this contract is the provisions of Delhi, Indian Law on the Protection of Consumers, and the Regulation on Distance Contracts, regarding the sale and delivery of the product, the qualifications and sales price of which are mentioned below, which the BUYER has ordered electronically (e-commerce) from the website belonging to the SELLER determination of the rights and obligations of the parties.

ARTICLE-3 FEATURES AND DELIVERY OF GOODS/SERVICES

3.1 Information on the Products

The subject of this contract incorporates the rights and obligations of the parties consonantly with the provisions of the Law on the Protection of Consumers and the Regulation on the Principles and Procedures of Implementation of Distance Contracts, regarding the sale and delivery of the product, of which the SELLER sells to the BUYER, whose qualities and sales price are mentioned below.

3.2 Delivery Type

The products sold on the (dwsthemes.com) website are Media Files and Software Programming files used in electronic media. Mode of Delivery after the BUYER has paid the cost of the product, the package you bought is installed by us and delivered as you see in the demo. You can edit the contents of your website from the administration panel. Only our consumers with membership status can use it in their own hosting.

ARTICLE 4 - GENERAL PROVISIONS

4.1: The BUYER announces that he has read all the prior information regarding the basic characteristics, sales price and payment method, and delivery of the product or products that are the subject of the contract specified in Article 3 and that he has provided the requisite confirmation in the electronic environment.

4.2: If the product subject to the contract is to be delivered to a person/organization other than the BUYER, cannot be held responsible for the person/organization to be delivered not accepting the delivery.

4.3: (dwsthemes.com) is responsible for the delivery of the product subject to the contract, intact, complete, and specified in the order.

4.4: The signed copy of this contract must be delivered to (……………) for the delivery of the product subject to the contract, or the price must be paid in the form of payment preferred by the BUYER. If for any reason the product price is not paid or canceled in the bank records, (…………) is deemed to be free from its obligation to deliver the product.

4.5: In the event that the relevant bank or financial institution fails to pay the product price to our company due to the unfair or unlawful use of the BUYER's credit card after the delivery of the product by unauthorized persons, which is not due to the Buyer's fault, the BUYER shall pay the price of the product to 3 It must be sent to (………….) within the same day.

4.9: (applies to dealers) delivered products to one (1) year software is provided free support-related problems.

4.10: (Applicable for resellers) No support is offered for Hosting-related issues if you are running the software you bought on your own hosting.

4.11: (Applicable for resellers) You are responsible for taking a backup of your site if you host the software you bought on your own server.

4.12: This contract becomes valid from the moment the BUYER buys the product or becomes a member.

ARTICLE 5 - RIGHT OF WITHDRAWAL

The BUYER does not have the right to withdraw or change the domain after the installation of the product subject to the contract to himself or to the domain indicated. Our products are licensed to the domain, there is no license tracking system, and license deletion cannot be done. For this reason, the utilization of the product emerges as soon as you obtain the web design package you ordered.

For this reason, there is no right of return, cancellation, or withdrawal after the web design package is installed on the domain or after the customer downloads the software files from the panel. However, if the customer has not installed the Web design package to the domain address and has not downloaded the software to his computer for the customers who did not receive the installation, the right to change the domain, withdraw and return arises.

Furthermore, the customer cannot exercise the right of withdrawal in web design packages that are formed consonantly with the special requests and demands of the customer or that are personalized by making changes or additions.

In case the payment is made by credit card or a similar payment card, the customer may request the cancellation of the payment transaction on the grounds that the card was used against his/her consent and illegally. In this case, the card issuer returns the payment amount to the consumer within 10 days from the notification of the objection.

In the implementation of this contract, the Consumer Arbitration Committees and the Consumer Courts in the settlement of (…………..) are authorized up to the value declared by the Ministry of Industry and Trade.

In the event that the order is concluded, the BUYER shall be deemed to have accepted all the terms of this contract.
